A Kebbi court has sentenced a man to five years in prison for attempting to sexually assault a 10-year-old girl

Court in Kebbi State has sentenced Ibrahim Isah from Zuru Local Government Area to five years in jail for trying to rape a 10-year-old girl.

In her ruling, Justice Maryam Abubakar Kaoje said Isah was guilty of attempting to commit rape, which is covered under Section 58 of the Kebbi State Penal Code Law, 2021.

Isah was first charged with two counts of rape and gross indecency under Sections 259 and 261 of the Penal Code.

But the court decided that the evidence didn’t prove the full crime of rape.

According to the court records, the prosecution, led by the Director of Public Prosecution, Lawal Hudu Garba, SAN, presented five witnesses and three exhibits, including Isah’s confessional statements in English and Hausa, and a medical report from the victim.

The defence, led by Barrister S.M. DanYaro, called one witness along with the defendant.

In her ruling, Justice Kaoje said the facts in the confessional statement showed an attempt to commit rape, which is a less serious crime than what was originally charged.

She then convicted Isah under Section 58 of the Penal Code.

The court sentenced Isah to five years in prison and ordered a fine of N50,000, with an extra one year in jail if the fine isn’t paid.
